Information provided to or collected by Packet Design
Packet Design collects personally identifiable information that is provided by a (a) Visitor to the Site including but not limited to a prospective employee or customer that submits an inquiry to Packet Design via online forms, inquiries at trade shows, or direct contact with our representatives; or (b) User of our Services. Packet Design’s Site and Services are not intended for use by children under the age of 13. We will not knowingly collect personally identifiable information from children and will delete such personally identifiable information upon discovery.
By visiting and accessing the Site and/or by submitting an inquiry to Packet Design, you consent to Packet Design’s collection and processing of the following types of personally identifiable information: name, telephone number, company name, company address, job title, email address, IP address, physical address, and related personally identifiable information that you voluntarily provide to Packet Design. You acknowledge that the collection and processing of such information may be necessary for use of the Site, including but not limited to a User’s use of the self-service portal.
By accessing and using the Services, you consent to Packet Design’s collection and processing of the following personally identifiable information regarding the User and/or an agent of the User: telephone number, company name, company address, job title, email address, physical address, IP address, device information, network information including devices, nodes, configurations, connection speeds, application performance, and geolocation information. You acknowledge that the collection and processing of such information is necessary for the performance of the Services by Packet Design for a User. In addition, we may obtain information, including personally identifiable information, from other sources and combine that with information we collect about you.
Limited Use and Disclosure of Information
We may use personally identifiable information for various purposes including: (a) provide, maintain, and improve the Services; (b) provide and deliver the software, technical support, and/or services you have ordered, process payments related thereto, and send you related information including confirmations and invoices; (c) resolve technical issues related to the Services, and send you communications related to updates, security, alerts, and related administrative messages; (d) respond to your communications and inquiries; (e) communicate or offer new products, services, offers, evaluations, surveys, invitations for conferences and seminars, and promotions offered by us and others; (f) link or combine with information we get from others to help understand your needs and provide you with better service, where permitted by applicable law; (g) carry out any other purpose that is compatible with the purpose for which the information was collected; (h) help diagnose problems with our server, and to administer our Site; (i) gather demographic information, such as the number of visitors to our Site; and (j) to contact you and respond to your inquiries submitted via the Site, including but not limited to providing you with promotional and marketing material from Packet Design and some of its partners.
We may contract with partners, suppliers, couriers, service providers, authorized third-party agents, and contractors (“Service Providers”) in order to provide a requested Service and/or process a transaction. By accessing the Site, using the Services, and/or otherwise providing personally identifiable information to us, you consent to Packet Design’s sharing of personally identifiable information you provide to its Service Providers to the extent necessary to deliver the Services, respond to requests for information on Services, or otherwise support your business needs. You acknowledge and agree that this sharing of information by Packet Design is necessary for the performance of Packet Design’s contractual obligations as set forth in the applicable order and that you may not have the opportunity to opt out of having your information shared with these Service Providers, and they may contact you directly regarding such Services. Packet Design will only provide these Service Providers with the minimum amount of information necessary to complete the requested Service or transaction and we require that they treat such information as confidential and use such information solely to perform the requested Service or transaction. Unless required by applicable law, Packet Design is not responsible for any improper use by such Service Providers.
You acknowledge and consent to Packet Design’s disclosure of your personally identifiable information, to: (a) our affiliates and subsidiaries worldwide for the purpose of data processing and collection; (b) our distributors, resellers, partners, and others in connection with the performance of our contractual obligations under any applicable order and/or for the purpose of marketing and sale of our Services; (c) with vendors, consultants, and service providers who need to access such information to perform contractual obligations on our behalf; (d) third parties if we believe your actions are in violation of any end user license agreement or policies, or to protect our rights, property, and safety, and the rights, property, and safety of others; and (e) third parties in connection with any proposed merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. In addition, we may also share aggregated or pseudonymized information that you provide that cannot reasonably be used to identify you.
Other than these instances, we will not use or disclose personally identifiable information except when we have your consent or under special circumstances, such as when we receive a request from law enforcement.
We have implemented physical, administrative, and technical safeguards designed to protect your personally identifiable information under our control from unauthorized access, loss, misuse and alteration. While we strive to protect your personally identifiable information, we cannot ensure the security of the information you transmit, and we recommend you take every reasonable precaution in protecting your personally identifiable information.
The Site and/or Service may provide links to third-party sites we believe may be of interest to you. These third-party sites are beyond Packet Design’s control and you are advised to check their applicable privacy policies before providing your personally identifiable information to them.
Your decision to provide personally identifiable information to Packet Design is voluntary provided that, if you do not provide the personally identifiable information requested, you may not be able to proceed with the Service or activity for which the personally identifiable information is being requested. Where required by law, Packet Design will offer you the opportunity to opt in before promotional materials are sent to you. This will not apply to other mandatory communications that are considered part of the Services, which you may receive periodically unless you cancel the Services. In all other instances, you can always unsubscribe or choose not to receive promotional information from us by following the specific instructions in the email you receive or by contacting us.
Packet Design strives to keep your personally identifiable information accurate and updated. As such, we will provide you with access to your information when reasonable or in accordance with relevant laws, including making a reasonable effort to provide you with a copy of such personally identifiable information for your review. We may take steps to verify your identity before granting access or making changes to your personally identifiable information to ensure the privacy and security of your personally identifiable information.
Requests to access, modify, correct, and/or delete personally identifiable information are subject to applicable legal, accounting, reporting, and/or other documentation retention obligations and we may retain your personally identifiable information to comply with such requirements for a reasonable period of time.
